Launching or Defending an Employment Law Claim?
 
For most types of employment tribunal claim, it is virtually a pre-condition of registering your a claim that the employee  should first have gone through an internal “grievance procedure” with their employer. Failure to do this may lead either to their claim being rejected completely, or to their compensation (if they win the case) being significantly reduced
.

Likewise, if they consider that they have been “unfairly dismissed”, it is virtually essential that they should appeal against the dismissal decision internally before bringing their claim
. Please be aware that there are strict time-limits for bringing Employment Tribunal claims. In most instances, the time limit is three months from the (last) date on which the matter complained of occurred, but this time-limit is extended to six months if the matter has been made the subject of a written grievance, or if a dismissal has been appealed (acas).
 
The rules governing these matters are very complex, but suffice it to say that every year many cases (including otherwise very strong cases) are rejected by employment tribunals either because the time-limits for bringing the claims have not been adhered to, or because internal grievance and appeals procedures have not been used first
.
 
The ET1 form which starts off their case should be prepared with great care, as it can be difficult later to rectify mistakes or shortcomings
.
 
Case Progress
 
 
Once they have submitted their ET1 form to their local tribunal hearing centre, it will then be forwarded on to the (former) employer, who has to file a response within 28 days. (If the employer fails to do this, they may not be allowed to defend the case)
(acas).
 
 Once the tribunal has received the employer’s response, the case papers will be considered by a tribunal chairman who will give directions on the steps that the parties are to take in order to prepare for the full hearing of the case. Typically, this consists of a timetable for exchange of documents, preparation of an agreed bundle of documents and also preparation of witness statements
.

Sometimes the chairman will also decide that there should be a preliminary hearing to resolve particular issues in the case prior to the full hearing. This is known as a “pre-hearing review” (PHR). A “case management discussion” (CMD) may also take place to resolve timetabling or other practical issues – these are often done by telephone

 
 
The papers in the case will also forwarded by the tribunal to ACAS (Advisory, Conciliation and Arbitration Service). Both sides will then be contacted by an ACAS official to explore the possibility of the case being resolved by way of “conciliation” – ie an ACAS-brokered financial settlement (known as a COT 3 agreement). In practice a substantial proportion of potential cases do get resolved by this means, so that a full hearing before an employment tribunal never takes place
.
 
Employment Tribunal Hearing
 
Should their case get as far as a full hearing, they need to bear in mind that appearing at a tribunal as a “litigant-in-person” is likely to be quite stressful. The tribunal chairman has an overriding duty to act in an even-handed manner towards both sides and therefore, and they may find, as a litigant-in- person, that they fail to do themselves full justice
.
 
For all the above reasons, it is highly desirable to obtain professional advice well before embarking or defending on an Employment Tribunal application – the sooner the better

What does the term No Win No Fee refer to?

The term No Win No Fee covers contingency fee arrangements, which allow claimants to proceed with a claim with little financial risk but not necessarily no financial risk as the claimant will be liable for administrative costs if they win. Our No Win No Fee employment law advisors and no win no fee employment solicitors will need to consider whether a No Win No Fee arrangement is appropriate. If a no win no fee agreement is appropriate in the circumstances the no win no fee advisor, representative or no win no fee employment solicitor engaged will proceed with the case and not charge claimant for work done unless they win the No Win No Fee case at which point, the representative or no win no fee employment solicitor would be paid a pre-agreed percentage of the compensation awarded as specified in the No Win No Fee agreement, plus disbursements such as photocopying, printing charges and associated administrative fees also dealt with in the No Win No Fee agreement.
However in pursuing the No Win No Fee case should the claimant lose the No Win No Fee case, they will not generally be liable for any legal fees to a no win no fee employment solicitor. This guidance comes with exceptions where a claimant does not fulfil their obligations under the No Win No Fee agreement. In which case they will be liable to pay the representative’s costs incurred up to the date the agreement ends calculated at the hourly rate and as specified in the agreement.

During the course of the progression of the No Win No Fee case where facts come to light which suggest that the claimant is unlikely to be successful in their No Win No Fee employment law case and the claimant rejects the advisor’s or no win no fee employment solicitor’s advice about making a settlement with the respondent, the claimant will be liable to pay the advisor or no win no fee employment solicitor’s costs. Some No Win No Fee agreements cover a specific part of the case and are restricted to a certain number of days attendance in the employment tribunal and may not include a counterclaim.
In conclusion a No Win No Fee agreement does give claimants who lack funding a way to pursue an employment law claim. However it is an arrangement which depends on whether the advisor or no win no fee employment solicitor assesses that the merits of the case are good.
